Comparative civil and commercial procedure

Lo scopo della giustizia civile, e cioè garantire un'efficace tutela dei diritti in un tempo ragionevole (e a costi ragionevoli), non è raggiungibile facendo riferimento a un unico modello procedimentale. Il corso analizza le principali caratteristiche dei diversi modelli procedimentali adottati in Europa e negli Stati Uniti. Gli studenti stranieri potranno comparare gli istituti trattati con quelli dei loro Paesi di provenienza.

Saranno trattati i principi e le più rilevanti caratteristiche dei sistemi: i. italiano; ii. inglese; iii. statunitense. Saranno quindi posti in evidenza i tratti di fondo che emergono dall'analisi dei sistemi esaminati.

Il corso è finalizzato a fornire agli studenti una visione del processo civile in dimensione comparatistica

Comparative civil and commercial procedure

The aim of civil justice, i.e. to guarantee an effective protection of rights within a reasonable time (and, of course, at reasonable costs), cannot be pursued through the same model of procedure. Focus of the course is to point out the essential features of different models of procedure adopted in Europe as well as in the United States. Foreigners students are welcome to compare one or more topics of the course with their respective legal systems.

Lessons take into account the principles and the main features of: i. Italian Civil Procedure; ii. English Civil Procedure; iii. U.S. Civil Procedure. At the end, the course will turn to the main trends and policies which have been raised from the analysis of the above mentioned systems.

The course aims to give an overview of civil proceedings in a comparative dimension

Lectures and, in the second part of the course, case study method.
