Course Syllabus
Obiettivi formativi
Il corso ha l’obiettivo di fornire allo studente la conoscenza dei principali istituti del diritto privato, attraverso lo studio del manuale, del codice civile e delle principali leggi del settore.
Il corso mira inoltre a stimolare la capacità di ragionamento dello studente, pertanto verranno proposti ed analizzati in lezione frontale casi pratici al fine di sviluppare capacità cognitive di collegamento fra i vari istituti per argomentare le soluzioni proposte dalle sentenze.
Lo studente, infine, sarà stimolato
alla lettura diretta delle più importanti sentenze che si occupano della materia privatistica in modo da dare un taglio non soltanto teorico della materia.
Contenuti sintetici
Il corso ha per oggetto l’individuazione delle linee fondamentali del sistema gius-privatistico, e l’apprendimento
delle principali nozioni riguardanti i suoi principali istituti.
Programma esteso
Norma giuridica e ordinamento giuridico. Rapporti
giuridici e situazioni soggettive. Situazioni attive e passive. Fatto e atto giuridico. Prescrizione e decadenza. Soggetti del rapporto giuridico. Persone fisiche. Persone giuridiche: associazioni, fondazioni, comitati. Le Obbligazioni (per esteso) . Debito e responsabilità patrimoniale. I mezzi
di conservazione della garanzia. Contratto in generale, contratti singoli, fatti illeciti e altre fonti di obbligazioni (esclusi titoli di credito).
Prerequisiti
Il corso di Istituzioni di diritto privato, essendo collocato al primo anno, non richiede particolari prerequisiti. E’
necessario, però, che sin dall’inizio lo studente manifesti capacità di ragionamento, di riflessione e di
coordinamento sistematico fra i diversi istituti del diritto privato oggetto di studio.
Metodi didattici
Il corso si articola in lezioni frontali in presenza e in lezioni da remoto sincrone e asincrone.
La piattaforma e-learning costituirà un supporto al corso. Durante le lezioni
verranno fornite indicazioni giurisprudenziali come materiale di corredo al manuale.
Modalità di verifica dell'apprendimento
Prova orale da remoto e quando possibile, in base alla normativa vigente, in presenza.

Per la preparazione all’esame si consiglia l’utilizzo del seguente testo: G. IORIO, Corso di diritto privato, Torino, Giappichelli, ultima edizione disponibile.
Nel caso in cui lo studente volesse utilizzare un manuale diverso è necessario concordarlo con il docente.
Learning objectives
The course aims to provide students with knowledge of the main institutes of private law, through the study of the manual, the civil code and the main laws in the field. The course also aims to stimulate the student's reasoning skills, therefore practical cases will be proposed and analysed in frontal lessons in order to develop cognitive skills
of connection between the various institutions in order to argue the solutions proposed by the judgments. Finally, the student will be stimulated to read directly the most important judgements dealing with the private matter in order to give a theoretical
and not only theoretical approach to the subject.
Contents
The aim of the course is to identify the fundamental lines of the legal-privatisation system, and to learn the main notions concerning its main institutions.
Detailed program
Legal system. Legal relations and subjective situations. Active and passive situations. Fact and legal act. Prescription and forfeiture. Subjects of the legal relationship. Natural persons. Legal persons: associations, foundations, committees. The Bonds . Debt and financial liability. The means of preservation of the guarantee. Contracts, individual contracts, torts and other sources of bonds (excluding debt securities). Advertising and transcription.
Prerequisites
The course of private law institutions, being placed in the first year, does not require any particular prerequisites.
It is necessary, however, that from the outset the student should demonstrate the student's ability to reason, reflect and
systematic coordination between the various private law institutions under study.
Teaching methods
The course consists of frontal lessons in presence and remote synchronous and asynchronous lessons.
The e-learning platform will support the course. During the lessons, jurisprudential information will be provided as an accompanying material to the manual.
Assessment methods
Oral test remotely and when possible, according to current regulations, in presence.

Should the student wish to use a different manual, this must be agreed with the teacher.
