Obiettivi formativi

L'insegnamento mira a far acquisire agli studenti la conoscenza approfondita e sistematica della disicplina consumeristica nazionale ed europea e lo sviluppo della capacità critica ed applicativa dei principali istituti, alla luce delle fonti di diritto interno ed europeo, con particolare attenzione alla disciplina dei diritti fondamentali del consumatore; del contrasto alle pratiche commerciali sleali ed alla pubblicità ingannevole; dei contratti del mondo del consumo negoziati fuori dai locali commerciali, a distanza e telematici; della sicurezza e della qualità dei prodotti e della responsabilità del produttore; della vendita dei beni di consumo. Con il completamento del corso, ci si attende che lo studente sia in grado di conoscere le nozioni fondamentali del diritto dei consumatori.

Contenuti sintetici

L'insegnamento introduce al diritto dei consumatori, analizzandone i fondamenti, le fonti nazionali, europee e internazionali e i principali diritti dei consumatori. Il programma approfondisce la disciplina dei contratti del consumatore, con particolare riferimento a formazione, recesso, calusole vessatorie, garanzie e rimedi, nonché alcuni contratti specifici e la responsabilità da prodotto difettoso. Completa il corso lo studio delle pratiche commerciali scorrette.

Il corso prevede l'attribuzione di n. 6 cfu e l'insegnamento è impartito nel secondo semestre.

Lezioni frontali, in lingua italiana, con ausilio di slides in power point

Modalità di verifica dell'apprendimento

L'esame si svolge in forma orale alla fine del corso e verterà sugli argomenti svolti a lezione e sui testi indicati. Non sono previste prove intermedie. Lo studente dovrà dimostrare conoscenza degli istituti del diritto dei consumatori, capacità di analisi di casi giuridici, capacità critica e proprietà di linguaggio giuridico.

Learning objectives

The course aims to provide students with an in-depth and systematic understanding of national and European consumer law, as well as to develop their critical and practical ability to apply its main legal concepts and institutions, in light of domestic and European legal sources. Particular attention will be devoted to the regulation of consumers’ fundamental rights; the prevention and suppression of unfair commercial practices and misleading advertising; consumer contracts concluded off-premises, at a distance and by electronic means; product safety and quality, as well as product liability; and the sale of consumer goods.
Upon completion of the course, students are expected to have acquired a sound knowledge of the fundamental principles and concepts of consumer law.

Contents

The course introduces students to consumer law by examining its foundations, national, European and international sources, and the main rights afforded to consumers. The syllabus focuses in particular on the regulation of consumer contracts, with specific reference to contract formation, withdrawal rights, unfair terms, guarantees and remedies, as well as certain specific types of contracts and liability for defective products. The course is completed by the study of unfair commercial practices.

The course carries 6 ECTS credits and is delivered in the second semester.

Knowledge of private law

Teaching methods

Lectures delivered in Italian, with the support of PowerPoint slides.

Assessment methods

The examination will be held orally at the end of the course and will cover the topics addressed during the lectures and the prescribed readings. No mid-term examinations are scheduled.
Students will be required to demonstrate knowledge of the main institutions of consumer law, the ability to analyse legal cases, critical reasoning skills, and appropriate command of legal terminology.
