Obiettivi formativi
Il corso mira a fornire un panorama delle possibili configurazioni assunte dal diritto di famiglia nella storia e nel diritto attuale.
Il modulo del corso si propone, in particolare, di fornire un'analisi approfondita del diritto di famiglia romano, della struttura della familia romana, dei poteri del pater familias, del rapporto padre e figli, della condizione della donna nella famiglia, dei rapporti tra coniugi, con uno sguardo all'influenza esercitata sulla concezione della famiglia nel corso dei secoli e sulle continuità e discontinuità con il diritto di famiglia attuale
Il corso mira a ottenere i seguenti risultati di apprendimento, in termini di abilità e competenze (descrittori di Dublino):
Conoscenza e comprensione
Conoscere e comprendere le basi teoriche del diritto romano della famiglia e del diritto di famiglia nei sistemi giuridici moderni, elaborando e/o applicando le conoscenze progressivamente acquisite a contenuti nuovi e strutture testuali originali.
Capacità di applicare conoscenza e comprensione
Applicare le conoscenze acquisite durante il corso attraverso esercizi di analisi di testi antichi e moderni. Sviluppare la capacità di comprensione della relazione tra assetto sociale e organizzazione giuridica nell’ambito del diritto di famiglia.
Autonomia di giudizio
Sviluppare la capacità di integrare le conoscenze e gestire la complessità, nonché di formulare giudizi sulla base di informazioni limitate o incomplete, includendo la riflessione sulle responsabilità sociali ed etiche collegate all’applicazione delle loro conoscenze e giudizi.
Abilità comunicative
Saper comunicare in modo chiaro e privo di ambiguità, a interlocutori specialisti e non specialisti, le proprie riflessioni e argomentazioni, nonché la base teorica dei ragionamenti.
Capacità di apprendimento
Sviluppare le capacità di apprendimento e allenare l’esercizio di analisi testuale in modo auto-diretto o autonomo.
Contenuti sintetici
Saranno presentate le basi del diritto di famiglia nel diritto romano, mostrandone il ruolo nella cultura dell'antica Roma.
Il corso inizierà con un quadro teorico e si svilupperà nella discussione di casi e altri materiali come leggi e altri strumenti legali. È richiesta la partecipazione attiva degli studenti, nonché suggerimenti di letture specifiche che faciliteranno la discussione durante il corso.
Programma esteso
l programma si articola nelle seguenti parti:
la familia romana;
la patria potestas e la sua evoluzione;
il nesso tra posizione all'interno della famiglia e capacità di agire nel mondo del diritto;
tutela e curatela;
il ruolo della donna nei rapporti familiari e patrimoniali;
l'adozione e le sue funzioni
Prerequisiti
Buone capacità di ragionamento e lettura di materiali giuridici.
Metodi didattici
19 lezioni di due ore in presenza, con una prima parte in modalità erogativa (DE) e una seconda parte interattiva (DI).
2 lezioni di due ore da remoto (modalità ascincrona)
Modalità di verifica dell'apprendimento
Esame finale orale (colloquio sugli argomenti svolti a lezione), per la verifica della preparazione sul
programma d’esame e per il controllo delle competenze acquisite.
La prova orale consiste in un colloquio sugli argomenti illustrati a lezione e indicati nei materiali di studio consigliati. Particolare rilevanza verrà data all’analisi dei materiali utilizzati in classe.
La prova mira a verificare la capacità di comprendere ed esporre in modo chiaro e personale gli argomenti e gli aspetti fondamentali della materia. I criteri di valutazione delle competenze indicate si basano sulla conoscenza e comprensione dei contenuti fondamentali della disciplina e sulla capacità di applicare le conoscenze acquisite.

Learning objectives
The course aims to provide an overview of the possible configurations assumed by family law in history and current law.
The course module aims, in particular, to provide an in-depth analysis of Roman family law, the structure of the Roman familia, the powers of the pater familias, the relationship between father and children, the condition of women in the family, the relationships between spouses, with a look at the influence exerted on the concept of the family over the centuries and on the continuities and discontinuities with current family law.
The course aspires to deliver the following learning outcomes in terms of skills and competences (Dublin descriptors):
Knowledge and understanding
Knowledge and understanding of the theoretical basis of Roman family law and family law in modern legal systems; capability to elaborate and/or apply the gradually acquired knowledge to new content and original text structures.
Applying knowledge and understanding
Application of knowledge acquired during the course, through exercises of ancient and modern text analysis. Development of the ability to understand the relationship between social order and legal organization, in the field of family law.
Making judgements
Ability to combine knowledge and deal with complexity, and to make judgements on the basis of limited or incomplete information, including reflection on the social and ethical responsibilities associated with the application of their knowledge and judgements.
Communication skills
Ability to communicate clearly and unambiguously, to specialist and non-specialist interlocutors, their own ideas and considerations, as well as the theoretical basis of reasoning.
Learning skills
Development of learning ability. Aptitude for practising text analysis in a self-directed or autonomous manner.
Contents
The course is structured in two parts: in the first part, devoted to ancient law, the basics of family law in Roman law will be presented, showing its role in ancient Roman culture.
The course will start with a theoretical framework and will develop in discussions of cases and other materials such laws and other concerning legal tools.
Active participation from students is required, as well as suggestions of specific readings that will facilitate discussion during the course.
Detailed program
The program articulates in the following parts:
the Roman family;
patria potestas and its evolution;
the link between position within the family and capacity to act in legal contexts;
guardianship and protection;
women's role in family and patrimonial relations;
adoption and its objectives.
Prerequisites
Good skills in reasoning and reading legal materials.
Teaching methods
19 two-hour lessons held in presence, with a first part face-to-face (DE) and a second part interactive (DI).
2 two-hour lessons delivered remotely (asynchronous mode)
Assessment methods
Final oral examination (interview), to check the preparation on the topics covered in class and to test the skills acquired.
The oral exam is an interview on the topics discussed in class and indicated in the recommended study materials. Particular emphasis will be placed on the analysis of materials used in the classroom.
The examination is aimed at testing the ability to understand and explain in a clear and personal manner the fundamental topics and issues of the discipline. The assessment criteria for the skills indicated are based on knowledge and understanding of the fundamental content of the discipline and the ability to apply the knowledge acquired.
