Obiettivi formativi

Obiettivo dell’insegnamento è fornire allo studente la conoscenza dei principî e degli istituti giuridici fondamentali per comprendere la struttura e il funzionamento delle pubbliche amministrazioni.

Al termine del corso, lo studente dovrà aver acquisito:

  • Conoscenza e comprensione dei principî e della disciplina normativa relativi all'organizzazione e all'attività delle pubbliche amministrazioni;
  • Capacità di applicare le nozioni apprese nell’analisi di casi concreti e nella risoluzione di problemi giuridici relativi alle principali manifestazioni dell'attività amministrativa;
  • Autonomia di giudizio nell’interpretazione delle norme e nell’individuazione delle soluzioni giuridiche più appropriate;
  • Abilità comunicative nella presentazione e discussione di argomenti giuridici, sia in forma scritta che orale;
  • Capacità di apprendimento autonomo, anche attraverso la consultazione di fonti normative, dottrinali e giurisprudenziali.

Contenuti sintetici

Il Corso ha ad oggetto l’analisi delle relazioni giuridiche tra cittadino e pubbliche amministrazioni attraverso lo studio dei principî e delle regole che informano l’organizzazione e l’attività amministrativa.

Programma esteso

  1. Il diritto amministrativo: introduzione;
  2. Il quadro generale di riferimento:
    Dallo Stato di diritto allo Stato sociale;
    Oltre lo Stato: la Convenzione europea dei diritti dell’uomo;
  3. La pubblica amministrazione in senso soggettivo:
    Le autorità amministrative indipendenti;
    Lo ‘Stato regionale’;
    Soggetti privati e diritto amministrativo;
  4. I principi generali:
    Dal principio di legalità alla régle de droit;
    Il principio di imparzialità;
    Il principio di buon andamento;
    Il principio del contraddittorio;
    Il principio dell'obbligo di motivazione;
    I principî di trasparenza e di pubblicità;
    I principî di proporzionalità e di ragionevolezza;
    Il principio del concorso pubblico;
  5. L’attività amministrativa: il procedimento e il provvedimento amministrativo:
    La legge sul procedimento amministrativo: inquadramento generale;
    L’iniziativa: responsabile del procedimento e comunicazione di avvio;
    La fase istruttoria (accertamento dei fatti e acquisizione di interessi);
    La partecipazione procedimentale;
    Le fasi decisorie: provvedimento, accordo e ‘silenzi’;
    L’invalidità del provvedimento: nullità e annullabilità;
    I procedimenti di riesame: la c.d. autotutela amministrativa;
    La S.C.I.A.;
  6. Le responsabilità pubbliche (dell’amministrazione e del funzionario).

Prerequisiti

È presupposta una conoscenza istituzionale del diritto costituzionale, con particolare riferimento ai seguenti argomenti:

  1. organizzazione dello Stato e tripartizione dei poteri;
  2. rapporti tra Stato nazionale e ordinamento europeo;
  3. ruolo delle regioni all’interno dell’ordinamento giuridico italiano;
  4. fonti del diritto nazionale (Costituzione, leggi, atti aventi forza di legge, regolamenti), regionale (leggi, statuti e regolamenti) ed europee (regolamenti e direttive, su tutti).

Metodi didattici

L’attività didattica si svolgerà interamente online, in modalità sincrona ed erogativa, attraverso lezioni dedicate alla trattazione e all’approfondimento degli argomenti oggetto del programma, favorendo la partecipazione attiva degli studenti.

Modalità di verifica dell'apprendimento

Esame orale finale sugli argomenti oggetto del programma, svolto attraverso un colloquio con il candidato finalizzato a verificare la conoscenza e la padronanza degli argomenti affrontati a lezione (o appresi tramite lo studio del manuale).

Sarà valutata la capacità di esposizione, la comprensione e applicazione dei concetti, l'autonomia di giudizio e la proprietà di linguaggio.

Materiale didattico predisposto dal docente e caricato sulla piattaforma di e-learning.

Si consiglia di affiancare al suddetto materiale lo studio del seguente manuale di Diritto amministrativo: M. Clarich, Manuale di diritto amministrativo, VI ed., Bologna, Il Mulino, 2024 (o edizione più recente, ove disponibile), esclusi i Capp. VI, XIII e XIV.

Learning objectives

The aim of the course is to provide students with knowledge of the fundamental legal principles and institutions necessary to understand the structure and functioning of public administrations.

By the end of the course, students are expected to have acquired:

  • Knowledge and understanding of the principles and regulatory framework governing the organization and functioning of public administrations;
  • The ability to apply acquired knowledge to the analysis of concrete cases and the resolution of legal issues concerning the main forms of administrative activity;
  • Independent judgment in interpreting legal norms and identifying the most appropriate legal solutions;
  • Communication skills in presenting and discussing legal topics, both in written and oral form;
  • The ability to engage in autonomous learning, including through the consultation of legal sources, academic literature, and case law.

Contents

The Course focuses on the analysis of legal relations between citizens and public administrations through the study of the principles and rules that inform the organization and administrative activity.

Detailed program

Prerequisites

Students are expected to possess a foundational knowledge of Constitutional Law, with particular reference to the following topics:

  • The organization of the State and the separation of powers;
  • The relationship between the national legal system and the European legal order;
  • The role of the Regions within the Italian legal system;
  • Sources of law at the national level (Constitution, statutes, delegated legislation and regulations), regional level (regional statutes, laws and regulations), and European level (in particular, regulations and directives).

Teaching methods

Teaching activities will be conducted entirely online in a synchronous, lecture-based format, through classes dedicated to the presentation and in-depth examination of the topics covered by the course syllabus, while encouraging the active participation of students.

Assessment methods

The final exam consists of an oral examination covering the topics included in the course syllabus. The exam takes the form of an interview aimed at assessing the student's knowledge and command of the subjects discussed in class (or studied through the textbook).

Assessment criteria will include clarity of presentation, understanding and application of legal concepts, independent judgment, and appropriate use of legal terminology.

Textbooks and Reading Materials

Teaching materials prepared by the instructor and made available on the e-learning platform.

Students are also encouraged to complement these materials with the study of the following textbook on Administrative Law: M. Clarich, Manuale di diritto amministrativo, 6th ed., Bologna, Il Mulino, 2024 (or a more recent edition, if available), excluding Chapters VI, XIII, and XIV.
