Obiettivi

Il corso si prefigge di fornire allo/alla studente/studentessa le conoscenze fondamentali relative al sistema delle relazioni sindacali e della contrattazione collettiva nel pubblico impiego, con particolare riferimento al settore sanitario. Al termine dell'insegnamento, lo/la studente/studentessa sarà in grado di comprendere il quadro normativo e contrattuale di riferimento, interpretare le principali disposizioni dei contratti collettivi nazionali di lavoro e riconoscere il ruolo delle relazioni sindacali nella gestione delle risorse umane e delle organizzazioni sanitarie.

Contenuti sintetici

Introduzione al diritto sindacale e al sistema delle relazioni sindacali. La contrattazione collettiva nel Servizio Sanitario Nazionale. Il Contratto Collettivo Nazionale di Lavoro del comparto sanità. Diritti e doveri dei lavoratori e del datore di lavoro. Relazioni sindacali, partecipazione, informazione e confronto. Gestione del personale e organizzazione del lavoro.

Programma esteso

Il corso approfondirà i principi del diritto sindacale e il quadro normativo che disciplina il lavoro alle dipendenze delle pubbliche amministrazioni, con particolare riferimento al Servizio Sanitario Nazionale. Saranno analizzati il sistema delle fonti della contrattazione collettiva, il ruolo dell'ARAN, delle organizzazioni sindacali e della rappresentanza sindacale nei luoghi di lavoro. Verranno esaminati la struttura e i contenuti del Contratto Collettivo Nazionale di Lavoro del comparto sanità, con particolare attenzione agli istituti contrattuali riguardanti il rapporto di lavoro, l'orario di servizio, gli incarichi, la valutazione, la formazione, i permessi, le responsabilità e la valorizzazione del personale. Saranno inoltre approfonditi gli strumenti delle relazioni sindacali, quali informazione, confronto e contrattazione integrativa, nonché il loro ruolo nella gestione del cambiamento organizzativo, nella prevenzione dei conflitti e nello sviluppo di un clima organizzativo favorevole alla qualità dei servizi e al benessere dei professionisti.

Aims

The course aims to provide students with fundamental knowledge of the system of trade union relations and collective bargaining within public employment, with particular reference to the healthcare sector. Upon completion of the course, students will be able to understand the relevant regulatory and contractual framework, interpret the main provisions of national collective labour agreements, and recognize the role of industrial relations in the management of human resources and healthcare organizations.

Contents

Introduction to labour union law and the system of industrial relations. Collective bargaining within the National Health Service. The National Collective Labour Agreement for the healthcare sector. Rights and duties of employees and employers. Trade union relations, participation, information sharing, and consultation processes. Human resource management and work organization.

Detailed program

The course explores the principles of labour union law and the regulatory framework governing employment relationships within public administrations, with particular reference to the National Health Service. Students will examine the system of sources regulating collective bargaining, the role of ARAN (Agency for the Negotiation Representation of Public Administrations), trade unions, and workplace union representation. The course will analyze the structure and contents of the National Collective Labour Agreement for the healthcare sector, with particular attention to contractual provisions concerning employment relationships, working hours, professional assignments, performance evaluation, training, leave entitlements, responsibilities, and the professional development and enhancement of healthcare workers. The course will also address the main tools of industrial relations, including information, consultation, and decentralized collective bargaining, highlighting their role in managing organizational change, preventing conflicts, and fostering a positive organizational climate that supports quality healthcare services and the well-being of professionals.
