Course Syllabus
Obiettivi formativi
Il corso esamina le regole di concorrenza dell’Unione europea. In particolare le regole comprese negli artt. 101-106 del TFUE.
Il diritto di concorrenza UE si compone di tre pilastri:
a) divieto di accordi anti-concorrenziali
b) divieto di abuso di posizione dominante e
c) regolamentazione di acquisizioni e concentrazioni.
Vi sono poi regole di diritto derivato a integrazione.
La Commissione UE fa rispettare il diritto di concorrenza UE un aspetto importante è l’interrelazione tra diritto ed economia.
Gli studenti non devono aver sostenuto necessariamente l’esame di diritto UE anche se in questo caso sono necessarie letture integrative.
Gli studenti devono prendere parte attivamente durante il corso durante seminari e gruppi di discussione. Devono anche presentare argomenti in aula al resto del gruppo

In coerenza con gli obiettivi formativi del corso, la didattica sarà svolta in lingua inglese e sarà organizzata in:
- lezioni frontali;
- discussione critica degli argomenti trattati
- risoluzione autonoma da parte dello studente di esercizi e compiti
- svolgimento di progetti individuali o in gruppo
- discussione di casi
Modalità di verifica dell'apprendimento
Coerentemente con gli obiettivi formativi e con i metodi didattici del corso, la modalità di verifica dell’apprendimento sarà
- per i frequentanti esame scritto con domande aperte integrato da un esame orale e valutazione della partecipazione attiva in aula. Le modalità di formazione del voto di esame saranno voti in trentesimi, di cui esame scritto 70% e partecipazione in aula 30%.

Learning objectives
The course examines the competition rules of the European Union; particularly the competition rules included in Articles 101-106 TFEU.
Competition law includes three "pillars":
a) prohibition of anti-competitive agreements (the "cartel prohibition");
b) prohibition of abuse of market power (the "abuse prohibition") and
c) regulation of mergers and take-overs ("Merger Control").
These rules are supplemented both by other Treaty provisions as well as secondary legislation.
The European Commission enforces the competition rules. The interrelation between Law and economics is very important in this field.
Students need no former knowledge of EU Law before taking this course, but it may require some additional reading.
Students are expected to take an active part in the course since the emphasis is placed upon seminars and discussion groups rather than formal lectures. Students must also be prepared to give presentations to the rest of the group

Teaching methods
Coherently with the aims of the course, the lecturing activity will be rendered in Italian and English will be organized in:
- frontal lectures;
- critical discussion of the selected topics
- autonomous solution of cases from the student and homeworks
- individual and group works and activities
- case discussions
Assessment methods
Coherently with the aims of the course and the lecturing modalities of the course, the evaluation modalities will be
- For the students that can attend classes written exam integrated by an oral exam with open questions and the grading of the active attendance in class. The grading modalities will be grade in thirties, the 70% of which will be rendered to the written exam and the active attendance in class 30%.
