Course Syllabus
Obiettivi formativi
Al termine di questo corso, è richiesto agli studenti di:
- Conoscere e comprendere la natura e le fonti del diritto internazionale umanitario, nonché avere una comprensione critica dei concetti fondamentali di questa disciplina;
- Essere in grado di identificare e valutare criticamente le implicazioni di tali concetti nell'esposizione sostanziale di vari problemi attinenti ai conflitti armati contemporanei internazionali e non internazionali;
- Dimostrare una comprensione approfondita dei vari strumenti giuridici internazionali relativi alla condotta delle ostilità e alla protezione delle categorie vulnerabili di persone e dell'ambiente, nonché del regime giuridico e della prassi relativi al divieto di utilizzo di determinate armi; e
- Essere in grado di applicare le conoscenze così acquisite a questioni specifiche che emergono in connessione con conflitti armati.
Contenuti sintetici
Il corso fornirà una panoramica e un'analisi delle regole e dei principi fondamentali che regolano la condotta dei conflitti armati, con particolare attenzione alla protezione delle persone vulnerabili, ai mezzi e ai metodi di guerra e alla questione della responsabilità per le violazioni delle norme del diritto internazionale umanitario.
Programma esteso
In particolare verranno affrontati i seguenti temi:
• Fonti e istituzioni
• Conflitti armati internazionali e conflitti armati interni
• La condotta delle ostilità
• La protezione delle persone vulnerabili
• La protezione dell'ambiente naturale durante i conflitti armati
• I mezzi e metodi di guerra:
• In particolare, il regime legale per le armi soggette a restrizioni e proibite
• Responsabilità per violazione delle norme del diritto internazionale umanitario (nozioni)

Le lezioni saranno tenute in lingua inglese.
Modalità di verifica dell'apprendimento
Esame orale: domande aperte durante un colloquio con lo studente al fine di verificare la preparazione sul programma d’esame.

Gli studenti frequentanti possono preparare l'esame sulla base del materiale distribuito durante le lezioni.

Learning objectives
Upon completing this course, students should:
- Know and understand the nature and sources of international humanitarian law, as well as have a critical understanding of its fundamental concepts;
- Be able to identify and critically assess the implications of those concepts in the substantive exposition of various issues of contemporary international and non-international armed conflicts;
- Demonstrate an in-depth understanding of various international legal instruments relating to the conduct of hostilities and the protection of vulnerable categories of persons and the environment, as well as of the legal regime and relevant practice related to the prohibition on the use of certain weapons; and
- Be able to apply the knowledge so acquired to specific issues arising in connection with armed conflicts.
Contents
The course will provide an overview and analysis of the basic rules and principles that regulate the conduct of armed conflict, with particular attention to the protection of vulnerable persons, to the means and methods of warfare and to the question of accountability for violations of the rules of international humanitarian law.
Detailed program
In particular, the following topics will be addressed:
- Sources and institutions
- International armed conflicts and internal armed conflicts
- The conduct of hostilities
- The protection of vulnerable persons
- The protection of the natural environment during armed conflict
- The means and methods of warfare:
- The legal regime for restricted and prohibited weapons
- Accountability for the violation of the rules of international humanitarian law (notions)
Teaching methods
Classes will be taught in English.
Assessment methods
Oral exam: open questions during an interview with the student in order to verify their knowledge of the Course program.
Textbooks and Reading Materials
Reading materials will be distributed during the seminars.
Students attending seminars may prepare the exam on the basis of the material distributed during the seminars.
Students not attending the seminars may prepare the exam on the following textbook: E. Crawford and A. Pert, 'International Humanitarian Law', 2nd ed., Cambridge University Press, 2020.
