Obiettivi formativi

Il corso si propone di analizzare gli istituti principali che informano la responsabilità degli enti derivante dalla commissione di un reato nel sistema italiano e in quello statunitense.

Contenuti sintetici

Si analizzerà la disciplina che regola l'accertamento della responsabilità degli enti per gli illeciti amministrativi dipendenti da reato. In particolare, ci si soffermerà sugli sviluppi processuali e sulle dinamiche probatorie verificandone la compatibilità costituzionale all'interno degli ordinamenti statunitensi e italiano.

Prerequisiti

Conoscenza del Diritto penale e del Diritto Processuale penale.

Metodi didattici

Le lezioni si svolgeranno in presenza e in modalità erogativa.

Modalità di verifica dell'apprendimento

Esame orale: colloquio sugli argomenti oggetto del programma.
Potranno essere previste prove scritte facoltative all'esito del corso di lezione.

Learning objectives

The course aims to analyse the main institutions that inform criminal liability in the US and Italian systems.

Contents

During the lectures, with erogative method, we will analyze the regulations governing the corporate criminal liability. In particular, we will look at procedural developments and evidentiary dynamics while verifying their constitutional compatibility in the US and Italian legal framework.

Detailed program

Prerequisites

Knowledge of criminal law and criminal procedural law.

Teaching methods

Lessons will be held in presence and with erogative method.

Assessment methods

Oral exam: interview on the topics covered by the program.
Optional written tests may be scheduled at the end of the lecture course.
