Obiettivi formativi

Il corso offre una panoramica sulle sfide giuridiche che i diritti religiosi pongono nella società contemporanea. Particolare attenzione sarà dedicata al diritto di famiglia e all'istituto del matrimonio.

Contenuti sintetici

Quando si esplora il mondo del diritto, ci si trova di fronte a una varietà affascinante di prospettive, che vanno oltre il mero ambito statale. Le religioni, infatti, possiedono sistemi giuridici interni che regolano diversi aspetti della vita dei fedeli. Questi sistemi mirano a guidare e disciplinare comportamenti specifici all'interno delle comunità religiose. L'analisi comparativa di tali normative rivela interessanti similitudini e differenze tra le tradizioni legali delle diverse fedi.
Il Corso rappresenta un'opportunità unica per esplorare tale complessità giuridica e concentrarsi sulle problematiche poste dalla regolamentazione del matrimonio nelle "religioni del libro": il diritto canonico della Chiesa cattolica, il diritto islamico (Sharia) e il diritto ebraico (Halakhah). Immergendoci in questi tre sistemi, inizieremo un viaggio nelle diverse tradizioni religiose, analizzando le norme, le pratiche e le implicazioni sociali e culturali legate a questo istituto.
Attraverso la comparazione, non solo si acquisirà una migliore comprensione del diritto matrimoniale all'interno delle religioni del libro, ma anche una visione più ampia delle varie concezioni di matrimonio, di famiglia e di comunità presenti nel tessuto sociale globale.

Capacità di problem solving.
Apertura mentale verso la complessità giuridica e la diversità religioso-culturale.

Metodi didattici

21 lezioni da due ore svolte in modalità erogativa in presenza.
E' previsto il collegamento in streaming via Webex per coloro che hanno necessità di collegarsi da remoto. Il collegamento deve essere previamente concordato con la Docente.

Modalità di verifica dell'apprendimento

Esame orale.
Non sono previste prove intermedie.

Learning objectives

The course provides an overview of the legal challenges that religious rights pose in contemporary society. Particular attention will be paid to family law and the institution of marriage.

When delving into the realm of law, one encounters a captivating array of perspectives that extend far beyond the mere confines of the state. Religions, in fact, boast internal legal systems that intricately regulate various aspects of believers' lives. These systems are designed to provide guidance and enforce discipline over specific behaviors within religious communities. Through comparative analysis of these regulations, intriguing similarities and differences among the legal traditions of different faiths are unveiled.
This course presents a unique opportunity to explore this legal complexity and delve into the legal intricacies surrounding the regulation of marriage in the "religions of the book": namely, the canon law of the Catholic Church, Islamic law (Sharia), and Jewish law (Halakhah). By immersing ourselves in these three distinct legal frameworks, we embark on a journey through diverse religious traditions, meticulously examining the norms, practices, and social and cultural implications associated with this institution.
Through this comparative approach, participants will not only attain a deeper understanding of matrimonial law within the "religions of the book" but also gain a broader perspective on the varying conceptions of marriage, family, and community within the global social fabric.
