Obiettivi formativi

Conoscenza e capacità di comprensione
Acquisire una conoscenza approfondita delle istituzioni che regolano le transazioni economiche nei mercati internazionali; disporre degli strumenti necessari per analizzare la legislazione da esse emanata e il suo impatto su scala globale.
Conoscenza e capacità di comprensione applicate
Sviluppare gli approcci e le metodologie di analisi giuridica del diritto della concorrenza.
Autonomia di giudizio
Durante le lezioni, gli studenti saranno suddivisi in gruppi per discutere dei casi. Ciò consentirà lo sviluppo di un giudizio critico, permettendo agli studenti di verificare l’applicazione pratica delle conoscenze teoriche acquisite.
Abilità comunicative
Le attività tra pari e l’analisi di casi reali faciliteranno la capacità di comunicare quanto appreso.
Capacità di apprendimento
Durante il corso saranno assegnati alcuni compiti che consentiranno agli studenti di migliorare le proprie capacità di apprendimento attraverso lo studio autonomo.

Contenuti sintetici

Il corso analizzerà in dettaglio le principali strutture organizzative, i meccanismi giuridici e gli strumenti operativi che regolano il rapporto tra i mercati e le istituzioni pubbliche a livello europeo e internazionale. La prima parte del corso sarà dedicata alle norme generali che regolano la concorrenza nel mercato europeo. La seconda parte analizzerà il cambiamento di prospettiva riguardo ai mercati digitali e le deroghe alle norme generali sulla concorrenza che l’UE ha elaborato nella Strategia digitale europea e attraverso alcuni regolamenti specifici, quali il Digital Markets Act e il Digital Services Act.

Metodi didattici

Il corso ha una durata di 56 ore. Una parte di esse sarà dedicata alle lezioni frontali tenute dal professore sui principali concetti generali del diritto della concorrenza; alcune ore saranno dedicate alla discussione di casi e a compiti da svolgere in gruppo. Nel corso del semestre potrebbero essere organizzati alcuni seminari con esperti provenienti da università straniere. Fino al 30% del corso potrebbe svolgersi a distanza.

Modalità di verifica dell'apprendimento

L'esame è scritto e consisterà in un test a scelta multipla e nella risposta a una domanda a risposta aperta. Gli studenti che partecipano ai compiti di gruppo saranno valutati attraverso la presentazione del compito alla classe e tramite un test a scelta multipla sulla parte generale del corso. Tale test si terrà durante la pausa di novembre.

Testi di riferimento

Il materiale di lettura verrà fornito ogni settimana dal professore tramite la piattaforma Moodle. Tale materiale sarà sufficiente per la preparazione all’esame sia per gli studenti che frequentano le lezioni sia per quelli che non le frequentano.

In ogni caso, gli studenti che ritengano necessario integrare la propria preparazione possono approfondire gli argomenti e i casi trattati nel libro: E. M. Fox, D. Gerard, «EU Competition Law. Cases, Texts and Context», Edward Elgar Publishing Limited, 2023. Il libro è disponibile anche in formato elettronico tramite la biblioteca universitaria.

Learning objectives

Knowledge and understanding
Provide an in-depth knowledge of the institutions regulating economic transactions in international markets; have the tools to analyze the legislation they produce and its impact on a global scale.
Applying knowledge and understanding
Develop the approaches and methodologies of legal analysis of competition law.
Making judgements
During the lectures, students will be grouped to discuss cases. This will allow the development of critical judgment, enabling students to verify the practical application of the theoretical knowledge acquired.
Communication skills
The activities between peers and the analysis of real-life cases will facilitate the ability to communicate what has been learned
Learning skills
During the course will be some assignments that will enable students to enhance their learning abilities through independent studying

Contents

The course will dissect the main organizational structures, legal mechanisms and operational tools governing the relationship between markets and public institutions at a European and international level. The first part of the course will be dedicated to the general rules governing the Competition within the European market. The second part will analyze the change of perspective reguarding the digital markets, and the derogation to general competition rules that EU has elaborated in the European Digital Strategy, and through some spefic regulations, such as the Digital Markets Act and the Digital Services Act.

Teaching methods

The course is 56 hours long. Part of them will be lectures hold by the Professor on the main general concept of Competition Law; some hours will be dedicated to the case discussion and to in-group assignements. Some seminars with experts from foreign universities could be organized during the semester. Up to 30% of the course could be in remote.

Assessment methods

The exam is written, and it will consist in a multiple choice test and in a aswer to an open question. Students attending the in-group assignments woll be evaluated through the prestentation of the assignement to the class and through a multiple choice test on the general part of the course. This test will be delivered during the november break.

Textbooks and Reading Materials

The reading materials will be provided every week by the Professor through the moodle platform. Those materials will be enough for the preparation of the exam for students both attending or non-attending the lectures.
Anyway, students that feel the need of an integration of their preparation can study the topics and the cases on the book: E. M. Fox, D. Gerard, "EU Competition Law. Cases, Texts and Context", Edward Elgar Publishing Limited, 2023. The book is also available as e-book through the university library.
