Syllabus del corso
Obiettivi formativi
Gli obiettivi specifici del corso sono:
- Conoscere le basi del diritto privato romano e comprendere la dimensione storica del diritto, come prodotto dell’uomo, nelle diverse forme sociali.
- Comprendere e acquisire il linguaggio giuridico, sapere applicare le categorie concettuali in relazione a casi pratici del passato o contemporanei.
- Acquisire autonomia di giudizio attraverso la comprensione delle radici degli attuali principi giuridici fondamentali, così da cogliere nel diritto romano uno strumento scientifico valido, per cercare autonomamente e criticamente le soluzioni che le società continuano a sollecitare in contesti via via diversi.
- Conseguire abilità comunicative di espressione giuridica efficace e precisa anche in relazione a casi pratici.
- Conseguire capacità di apprendere in modo autonomo, studiare criticamente i testi proposti, cercare criticamente soluzioni ai casi e alle discussioni proposte in aula.
Contenuti sintetici
Il diritto è un prodotto umano, che vive nella storia. I giuristi romani, nel corso di più di mille anni, elaborarono il diritto come sapere tecnico e argomentativo, volto a risolvere i conflitti concreti. Gran parte delle categorie, del linguaggio e dei metodi del giurista contemporaneo affondano le proprie radici nell'esperienza giuridica romana. Per tale ragione il corso esamina le principali categorie del diritto privato romano nel loro sviluppo storico e sistematico.
Saranno analizzati le fonti del diritto, il processo privato e il sistema delle azioni, le persone e i rapporti familiari, i fatti e i negozi giuridici, le obbligazioni, le cose e i diritti reali, le successioni e le donazioni.
L'esposizione privilegia la prospettiva processuale e il metodo argomentativo elaborato dai giuristi romani. Il processo e le azioni costituiscono infatti una chiave privilegiata per comprendere la formazione e l'evoluzione delle categorie giuridiche.
Programma esteso
Durante il corso verrà preso in esame lo sviluppo storico degli istituti del diritto privato romano dalle origini (VIII secolo a. C.) al Corpus iuris civilis di Giustiniano (VI secolo d.C.). Segnatamente, verranno trattati i seguenti argomenti:
- il diritto romano, i periodi, le fonti
- il processo: tipi di azione, modelli del processo privato romano
- le persone e i rapporti giuridici endo- ed eso- famigliari
- i negozi giuridici
- le cose e le categorie giuridiche a esse relative
- i diritti reali e i negozi a essi relativi
- le obbligazioni
- il diritto successorio
Prerequisiti
Gli studenti devono avere una buona conoscenza della lingua italiana nonché una buona cultura generale e specificamente una conoscenza di massima della storia romana.
Metodi didattici
Il corso sarà impartito in 36 lezioni di 2 ore ciascuna, svolte in modalità erogativa in presenza, più il tutorato (a frequenza facoltativa) svolto in modo interattivo in forma di esercitazione. Se necessario, fino a 8 lezioni di 2 ore ciascuna potranno essere svolte in modalità erogativa da remoto asincrono (lezioni registrate), a discrezione del docente, per fare fronte a situazioni eccezionali e al fine di garantire la continuità dell'attività didattica. Maggiori precisazioni saranno fornite nel corso del semestre.
Modalità di verifica dell'apprendimento
- Modalità di verifica per i soli appelli di gennaio e febbraio:
esame parziale scritto con test a risposte multiple, avente a oggetto gli argomenti del libro di testo a esclusione di obbligazioni e successioni + esame orale (condizionato dal superamento con esito superiore a 18/30 dello scritto di 30 domande, ciascuna delle quali viene valutata, a fronte di risposta corretta, con 1 punto; non è previsto punteggio negativo per le risposte scorrette) sugli ultimi argomenti svolti a lezione e sul testo d'esame (obbligazioni e successioni).
I voti dei due parziali concorrono a determinare il voto finale. - Modalità di verifica per gli altri appelli successivi:
esame solo orale sull'intero programma.
In tutte le prove, orali e scritte, la commissione valuterà le competenze acquisite dai candidati in termini di: nozioni giuridiche di base, istituzione di collegamenti tra le stesse, esposizione giuridicamente corretta.
**INTEGRAZIONI:chi deve sostenere l'integrazione, avendo effettuato il passaggio da Scienze dei servizi giuridici, deve portare le parti del programma relative a PROCESSO e SUCCESSIONI. Anche il libro di testo già utilizzato alla triennale va bene.

Learning objectives
The specific objectives of the course are:
- To gain an understanding of the foundations of Roman private law and to comprehend the historical dimension of law, as a human creation, within different social structures.
- To understand and master legal terminology, and to be able to apply conceptual categories to practical cases from the past or the present.
- To develop independent judgement through an understanding of the roots of current fundamental legal principles, so as to recognise Roman law as a valid scientific tool for independently and critically seeking the solutions that societies continue to demand in increasingly diverse contexts.
- To develop effective and precise legal communication skills, including in relation to practical cases.
- To develop the ability to learn independently, to study the assigned texts critically, and to critically seek solutions to the cases and discussions presented in class.
Contents
Law is a human creation, rooted in history. Over the course of more than a thousand years, Roman jurists developed the law as a technical and argumentative discipline, aimed at resolving specific conflicts. Much of the terminology, language and methodology used by contemporary jurists has its roots in Roman legal practice. For this reason, the course examines the main categories of Roman private law in terms of their historical and systematic development.
The course will analyse the sources of law, private litigation and the system of legal actions, persons and family relationships, legal facts and transactions, obligations, property and rights in rem, and succession and gifts.
The course focuses on the procedural perspective and the method of argumentation developed by Roman jurists. Proceedings and actions are, in fact, a key to understand the formation and evolution of legal categories.
Detailed program
Subject of this class will be the historical development of the institutions of Roman private law from the beginning (VIII century b.C.) to the Corpus iuris civilis of Justinian (VI century A.D.), namely about the following topics:
- Roman law, periods, sources
- trial: kind of actions, standard private roman trials
- persons and ends-familial relationships
- legal transactions
- things and their categories
- real rights and concerning legal transactions
- obligations
- inheritance law
Prerequisites
Students should have a good knowledge of Italian language, a good general culture and specifically a good general knowledge of Roman history.
Teaching methods
The course will be delivered in 36 lectures of 2 hours each, conducted in face-to-face delivery mode, plus tutoring (optional) in an interactive form of exercise. If necessary, up to 8 lectures of 2 hours each, may be conducted in asynchronous remote delivery mode (recorded lectures), at the discretion of the lecturer, to cope with exceptional situations and in order to ensure the continuity of teaching activities. More details will be provided during the semester.
Assessment methods
- Modality of examination for the January and February appeals only:
written partial exam covering the topics of the textbook excluding bonds and successions + oral exam (conditional on passing with a score of more than 18/30 in the written test of 30 questions, each of which is evaluated, with correct answers, with 1 point; there is no negative score for incorrect answers) on the last topics of the course and of the chosen text (bonds and successions).
The grades of the two partials combine to determine the final grade. - Mode of testing for other appeals:
oral examination on the entire program.
In all tests, oral and written, the committee will assess the skills acquired by the candidates in terms of: basic legal notions, establishment of links between them, legally correct presentation.
**INTEGRATIONS:Those who have to take the integration, having made the transition from Legal Services Science, should bring the parts of the syllabus related to TRIAL and SUCCESSION. The textbook already used in the three-year degree is also fine.
