Course Syllabus
Obiettivi formativi
ll corso ha l’obiettivo di fornire allo studente la conoscenza dei principali istituti del diritto privato, attraverso lo studio del manuale, del codice civile e delle principali leggi del settore. Il corso mira inoltre a stimolare la capacità di ragionamento dello studente, che attraverso lo studio di casi pratici dovrà essere in grado di ragionare autonomamente, individuando la norma da applicare alla fattispecie concreta.

Il corso ha per oggetto l’individuazione delle linee fondamentali del sistema di diritto privato, e l’apprendimento delle principali nozioni riguardanti i suoi istituti
Programma esteso
Il diritto e la norma giuridica. Il rapporto giuridico e le situazioni giuridiche attive e passive. Le persone fisiche. Nozioni generali sulle obbligazioni. L'adempimento nelle obbligazioni. L'inadempimento delle obbligazioni e il risarcimento del danno. Profili definitori e classificatori del contratto. L'accordo delle parti contrattuali. I vizi della volontà nel contratto. La struttura del fatto illecito. Il risarcimento dei danni da fatto illecito: danni patrimoniali e danni non patrimoniali. Principi e nozioni del diritto di famiglia. La separazione e il divorzio fra i coniugi
Prerequisiti
ll corso di Istituzioni di diritto privato non richiede particolari prerequisiti. E’ necessario, però, che sin dall’inizio lo studente manifesti capacità di ragionamento, di riflessione e di coordinamento sistematico fra i diversi istituti del diritto privato oggetto di studio.
Metodi didattici
Il corso si articola in lezioni frontali, in presenza. Durante le lezioni verranno fornite indicazioni bibliografiche e giurisprudenziali.
Modalità di verifica dell'apprendimento
Esame Orale. Lo studente e la studentessa verranno interrogati sul programma indicato nel Syllabus e sulle parti del libro indicate nel Syllabus. L'esame orale mirerà a verificare l'apprendimento degli istituti oggetto del programma e la capacità di ragionamento dello studente e della studentessa.

Learning objectives
The course aims to provide the student with knowledge of the main institutions of private law, through the study of the manual, the civil code and the main laws of the sector. The course also aims to stimulate the reasoning ability of the student, who through the study of practical cases must be able to reason independently, identifying the rule to be applied to the specific case.
Contents
The course has as its object the identification of the fundamental lines of the private law system, and the learning of the main concepts regarding its institutions
Detailed program
The law and the juridical norm. The legal relationship and active and passive legal situations. Individuals. General notions on bonds. The fulfillment of the obligations. Non-fulfillment of obligations and compensation for damage. Contract defining and classifying profiles. The agreement of the contractual parties. The vices of the will in the contract. The structure of the tort. Compensation for damages from unlawful acts: pecuniary damage and non-pecuniary damage. Principles and notions of family law. Separation and divorce between spouses
Prerequisites
The Institutions of Private Law course does not require particular prerequisites. It is necessary, however, that from the outset the student demonstrates the ability to reason, reflect and systematically coordinate between the various institutions of private law being studied.
Teaching methods
The course is divided into face-to-face lessons. Bibliographic and jurisprudential information will be provided during the lessons.
Assessment methods
Oral examination. The student will be asked about the program indicated in the Syllabus and the parts of the book indicated in the Syllabus. The oral exam will aim at verifying the learning of the institutions covered by the program and the reasoning skills of the student.
